ברוכים הבאים לאתר פוקימניה (להלן: "האתר") ולקהילות הקשורות אליו (Discord, Whatsapp, Telegram, Facebook, וכל פלטפורמה נוספת שתוקם בעתיד).
האתר משמש עמוד נחיתה והפניה לקבוצות הקהילתיות, וכן כולל קישורים חיצוניים לאתרים ולמוצרים. תקנון זה חל במלואו הן על השימוש באתר והן על ההשתתפות בקהילות. שימוש באתר או בקהילות מהווה הסכמה מלאה ובלתי חוזרת לתנאים המפורטים בתקנון זה. אם אינך מסכים/ה – אנא הימנע/י מהשימוש.
1. הגדרות
1.1 "מפעילי האתר/הקהילה" – בעל האתר והקהילות הנלוות. המונח כולל גם מי מטעמו המנהלים ומפעילים את האתר והקהילות.
1.2 "הקהילות" – קבוצות פוקימניה הפועלות בפלטפורמות צד שלישי לרבות Whatsapp, Telegram, Discord ו-Facebook, וכל פלטפורמה נוספת שתוקם או תנוהל על-ידי המפעילים בעתיד.
1.3 "משתמש" – כל אדם הנכנס לאתר, גולש בו, לוחץ על קישורים, או משתתף בפעילות כלשהי באתר או בקהילות.
1.4 "אתרים חיצוניים" – אתרי אינטרנט ושירותים שאינם בבעלות או בשליטת המפעילים, לרבות Amazon ואתרי מסחר נוספים, אליהם מפנה האתר או הקהילות.
1.5 "קישורי שותפים (Affiliate)" – קישורים שבאמצעותם עשוי המפעיל לקבל עמלה בגין רכישות המתבצעות דרך אותם קישורים, ללא שינוי במחיר לצרכן.
1.6 "מידע אישי" – כל מידע כהגדרתו בחוק הגנת הפרטיות, תשמ"א-1981, המאפשר זיהוי של אדם, לרבות אך לא רק: שם, כתובת דוא"ל, מספר טלפון, כתובת IP, נתוני שימוש באתר או בקהילות.
2. תנאי שימוש
2.1 האתר והקהילות אינם אתר מסחרי ואינם מספקים מכירה ישירה.
2.2 חלק מהקישורים באתר ובקהילות הם קישורי שותפים (Affiliate Links).

2.4 בנוסף, מפעילי האתר עשויים להשתתף בתכניות אפיליאציה אחרות ולקבל עמלה בגין רכישות או הרשמות המתבצעות באמצעות קישורים אלו – ללא שינוי במחיר לצרכן.
2.5 מפעילי האתר אינם צד לעסקאות עם אתרים חיצוניים, ואינם אחראים למחיר, מלאי, איכות, התאמה, אספקה, אחריות למוצרים, או לכל התחייבות אחרת של אתרים אלו.
2.6 המידע המפורסם באתר ובקהילות הינו מידע כללי בלבד, ואין לראות בו ייעוץ פיננסי, השקעה, מסחרי או מקצועי מכל סוג.
2.7 השימוש באתר ובקהילות מיועד למשתמשים מעל גיל 18. אם אינך עומד/ת בתנאי גיל זה – אין לעשות שימוש באתר או בקהילות.
2.8 מפעילי האתר שומרים לעצמם את הזכות, לפי שיקול דעתם הבלעדי, לשנות, לעדכן, להסיר או להפסיק פרסום של תכנים באתר ובקהילות, וכן לשנות את תנאי השימוש, בכל עת וללא הודעה מוקדמת.
2.9 מפעילי האתר אינם מתחייבים לכך שהתוכן באתר ובקהילות יהיה מדויק, מלא, עדכני או זמין בכל עת, ואינם אחראים לכל תקלה טכנית, הפסקת שירות או טעות במידע.
2.10 זכויות שימוש באתר - השימוש באתר ובקהילות מיועד למטרות אישיות ופרטיות בלבד. חל איסור לעשות שימוש באתר, בתכנים שבו או בקהילות למטרות מסחריות, שיווקיות, או כל מטרה אחרת החורגת מהשימוש האישי, אלא אם ניתן לכך אישור מפורש מראש ובכתב ממפעילי האתר.
3. התנהגות בקהילות
3.1 הקהילות של פוקימניה מיועדות לשיתוף דילים, מידע, ותוכן רלוונטי באווירה חיובית ומכבדת.
3.2 חל איסור מוחלט על פרסום תכנים פוגעניים, גזעניים, אלימים, פורנוגרפיים, מאיימים, מסיתים, משמיצים, או כל תוכן אחר העלול לפגוע במשתמשים או בצדדים שלישיים.
3.3 חל איסור על פרסום מסחרי, שיווקי, או קישורים לקבוצות/אתרים אחרים – אלא אם ניתן לכך אישור מפורש מראש ובכתב ממפעילי הקהילה.
3.4 חל איסור על הונאות, מכירת זיופים, שליחת ספאם, התחזות לאדם אחר, איסוף פרטים של משתמשים אחרים לצורך שיווק, וכן איסור על Harvesting, Phishing, או כל פעולה של איסוף מידע אישי שלא כדין.
3.5 השימוש בקהילות כפוף בנוסף לכללי הפלטפורמות המארחות, לרבות Discord Community Guidelines, Whatsapp Terms of Service, Telegram Terms of Service, ו-Facebook Community Standards.
3.6 הפרת כללי הפלטפורמות תיחשב כהפרה של תקנון זה.
3.7 מפעילי הקהילה רשאים, לפי שיקול דעתם הבלעדי, להסיר תכנים, לחסום או להוציא משתמשים – זמנית או לצמיתות – במקרה של הפרת התקנון או כללי הפלטפורמות.
4. מדיניות פרטיות
4.1 איסוף מידע – האתר עושה שימוש בטכנולוגיות צד שלישי (כגון Google Analytics, Meta/Facebook Pixel וכלים נוספים) לצורך מדידה, אנליטיקה, התאמת תוכן ופרסום, ושיפור חוויית המשתמש.
4.2 עוגיות (Cookies) – האתר עושה שימוש בקובצי Cookies ובטכנולוגיות דומות לצרכים תפעוליים, סטטיסטיים ושיווקיים.
4.3 מטרות עיבוד – המידע נאסף ומעובד לצורך ניהול ותפעול האתר והקהילות, שיפור השירות וחוויית המשתמש, התאמת פרסום ותוכן, וניתוח סטטיסטי.
4.4 מקבלי המידע – המידע נאסף ומעובד באמצעות ספקי שירות צד שלישי כגון Google ו-Meta, וכן פלטפורמות חיצוניות נוספות בהן פועלות הקהילות (Discord, Whatsapp, Telegram).
4.5 חלק מהמידע עשוי להישמר או לעובד בשרתי צד שלישי מחוץ לישראל (ובכלל זה בארה"ב ובאירופה).
4.6 הבהרה: פרט לספקי שירות צד שלישי המנויים לעיל, המפעילים אינם שומרים מידע במערכות CRM או שירותי דיוור צד שלישי אחרים.
4.7 תקופות שמירה – המפעילים עצמם אינם שומרים מידע אישי במערכות פנימיות. כל מידע שנאסף דרך האתר או הקהילות נשמר ומעובד על־ידי ספקי שירות צד שלישי בהתאם למדיניות הפרטיות ותקופות השמירה שלהם.
4.8 זכויות המשתמש – בהתאם לחוק הגנת הפרטיות, המשתמש זכאי לעיין במידע השמור עליו, לבקש תיקון, עדכון או מחיקה של מידע, להתנגד לעיבוד מידע לצורכי שיווק, ולהגיש תלונה לרשות להגנת הפרטיות בישראל.
4.9 פניות – כל בקשה או שאלה בנושא פרטיות ניתן להפנות בהודעה פרטית בכל אחת מהרשתות בהן אנו פועלים.
4.10 אבטחת מידע – אנו פועלים בהתאם לתקנות הגנת הפרטיות (אבטחת מידע), ומיישמים אמצעי הגנה סבירים למניעת שימוש בלתי מורשה, דליפה או חשיפה של מידע אישי.
4.11 מידע על קטינים – השימוש באתר ובקהילות מיועד למשתמשים מעל גיל 18 בלבד. אין בכוונתנו לאסוף או לשמור ביודעין מידע אישי על קטינים מתחת לגיל 18.
5. שיווק ישיר
5.1 מסרים פרסומיים (כהגדרתם בחוק התקשורת – "חוק הספאם") יישלחו רק לאחר קבלת הסכמה מפורשת (opt-in) מהמשתמש, ויכללו זיהוי ברור של השולח ואפשרות הסרה מיידית ונוחה.
5.2 הצטרפות לקהילה אינה מהווה כשלעצמה הסכמה לקבלת מסרים פרסומיים ישירים מחוץ לפעילות השוטפת של הקהילה.
5.3 שליחת הודעות BroadCast, דיוורים בדוא"ל, מסרי Whatsapp, Telegram ישירים, או כל מסר פרסומי אחר – תעשה רק לאחר קבלת הסכמה נפרדת ומפורשת מהמשתמש.
5.4 המשתמש רשאי בכל עת לחזור בו מהסכמתו, באמצעות מנגנון ההסרה שיצורף לכל מסר פרסומי או באמצעות פניה למפעילי האתר.
6. זכויות יוצרים וסימני מסחר
6.1 חל איסור מוחלט להעתיק, לשכפל, להפיץ, לפרסם, לתרגם, לשדר, לאחסן, להציג בפומבי או לעשות כל שימוש אחר – מסחרי או פרטי – בתכני האתר והקהילות, אלא אם ניתן לכך אישור מפורש מראש ובכתב מהמפעילים.
6.2 תוכן משתמשים: כל תוכן שהמשתמשים מפרסמים בקהילות נותר בבעלותם, אולם המשתמש מעניק למפעילים רישיון בלתי־בלעדי, חינמי, כלל־עולמי וללא הגבלת זמן להשתמש בתכנים אלו לצרכים הקשורים בקהילה ובאתר.
6.3 אחריות לתוכן משתמשים: המפעילים אינם נושאים באחריות לכל תוכן המועלה על-ידי משתמשים בקהילות. האחריות המלאה והבלעדית לתוכן זה חלה על המשתמשים שהעלו אותו.
6.4 דיסקליימר סימני מסחר: האתר והקהילות של פוקימניה אינם קשורים, מאושרים או ממומנים על ידי The Pokémon Company, Nintendo, או Amazon. כל סימני המסחר, השמות והלוגואים המוזכרים באתר ובקהילות שייכים לבעליהם החוקיים בלבד.
7. הגבלת אחריות ושיפוי
7.1 שירות As-Is – האתר, הקהילות וכל השירותים הקשורים אליהם ניתנים כפי שהם (As-Is), ללא כל אחריות, התחייבות או מצג מצד המפעילים.
7.2 שירות חינמי – השימוש באתר ובקהילות של פוקימניה ניתן למשתמשים בחינם. מפעילי האתר אינם גובים תשלום ישיר מהמשתמשים בעבור השימוש באתר או בקהילות.
7.3 אי־מתן התחייבות לזמינות או תקינות – המפעילים אינם מתחייבים שהשירות יפעל ללא הפסקות, תקלות או שגיאות.
7.4 הגבלת אחריות לנזקים – המפעילים אינם אחראים לכל נזק, ישיר או עקיף, תוצאתי או מיוחד, שייגרם עקב שימוש באתר, בקהילות או בקישורים חיצוניים.
7.5 הבהרה לעניין מידע אישי – מפעילי האתר אינם מנהלים מאגר מידע עצמאי ואינם שומרים מידע אישי של המשתמשים במערכות פנימיות. כל איסוף מידע או שמירת מידע אישי נעשה באמצעות ספקי שירות צד שלישי.
7.6 הגבלת אחריות כוללת – מאחר שהשירות ניתן כיום ללא תשלום, מוסכם כי בכל מקרה אחריותם הכוללת של המפעילים כלפי המשתמשים, אם תוכר אחריות כלשהי על פי דין, לא תעלה על הסכום ששולם בפועל למפעילים (אם שולם).
7.7 שיפוי – המשתמש מתחייב לשפות ולפצות את המפעילים, עובדיהם, שלוחיהם או מי מטעמם בגין כל נזק, הוצאה, תביעה או דרישה שייגרמו עקב הפרת תנאי שימוש אלו.
8. סמכות שיפוט
8.1 הדין החל הוא דיני מדינת ישראל. סמכות השיפוט הבלעדית - בתי המשפט במחוז תל אביב-יפו.
9. שונות
9.1 הפרדת סעיפים: אם ייקבע כי סעיף כלשהו בתקנון זה אינו תקף או אכיף, הדבר לא ישפיע על יתר הסעיפים, אשר ימשיכו להיות בתוקף מלא.
9.2 אי־ויתור: אי־מימוש זכות על-ידי המפעילים, באופן חד-פעמי או מתמשך, לא יהווה ויתור על זכות זו או על כל זכות אחרת.
9.3 עדכון תנאים: המפעילים שומרים לעצמם את הזכות לעדכן או לשנות את התקנון בכל עת. עדכון ייכנס לתוקף עם פרסומו באתר.
9.4 כוח עליון: המפעילים לא יהיו אחראים לכל עיכוב, הפרעה או מניעה בקיום התחייבותיהם הנובעים מאירועים שאינם בשליטתם הסבירה.

The Website serves as a landing page and referral to community groups, and also includes external links to websites and products. 1. Definitions
1.1 "Website/Community Operators" – the owner of the Website and associated communities. The term also includes those acting on their behalf who manage and operate the Website and communities.
1.2 "The Communities" – PokeMania groups operating on third-party platforms including Whatsapp, Telegram, Discord and Facebook, and any additional platform that may be established or managed by the Operators in the future.
1.3 "User" – any person who enters the Website, browses it, clicks on links, or participates in any activity on the Website or communities.
1.4 "External Websites" – websites and services not owned or controlled by the Operators, including Amazon and other commerce sites, to which the Website or communities refer.
1.5 "Affiliate Links" – links through which the Operator may receive a commission for purchases made through those links, without any change in price to the consumer.
1.6 "Personal Information" – any information as defined in the Protection of Privacy Law, 1981, that enables identification of a person, including but not limited to: name, email address, phone number, IP address, usage data on the Website or communities.
2. Terms of Use
2.1 The Website and communities are not a commercial website and do not provide direct sales.
2.2 Some links on the Website and communities are Affiliate Links.

3. Community Conduct
3.1 PokeMania communities are intended for sharing deals, information, and relevant content in a positive and respectful atmosphere.
3.2 It is strictly prohibited to publish offensive, racist, violent, pornographic, threatening, inciting, defamatory content, or any other content that may harm users or third parties.
3.3 It is prohibited to publish commercial, marketing content, or links to other groups/websites – unless explicit prior written approval is obtained from Community Operators.
3.4 It is prohibited to engage in fraud, sell counterfeits, send spam, impersonate another person, collect details of other users for marketing purposes, as well as prohibit Harvesting, Phishing, or any action of collecting personal information unlawfully.
3.5 Use of communities is also subject to the hosting platform rules, including Discord Community Guidelines, Whatsapp Terms of Service, Telegram Terms of Service, and Facebook Community Standards.
3.6 Violation of platform rules will be considered a violation of these terms.
3.7 Community Operators may, at their sole discretion, remove content, block or remove users – temporarily or permanently – in case of violation of these terms or platform rules.
4. Privacy Policy
4.1 Information Collection – The Website uses third-party technologies (such as Google Analytics, Meta/Facebook Pixel and additional tools) for measurement, analytics, content and advertising customization, and user experience improvement.
4.2 Cookies – The Website uses Cookies and similar technologies for operational, statistical and marketing purposes.
4.3 Processing Purposes – Information is collected and processed for managing and operating the Website and communities, improving service and user experience, customizing advertising and content, and statistical analysis.
4.4 Information Recipients – Information is collected and processed through third-party service providers such as Google and Meta, as well as additional external platforms where communities operate (Discord, Whatsapp, Telegram).
4.5 Some information may be stored or processed on third-party servers outside Israel (including in the USA and Europe).
4.6 Clarification: Apart from the third-party service providers listed above, Operators do not store information in CRM systems or other third-party mailing services.
4.7 Retention Periods – Operators themselves do not store personal information in internal systems. All information collected through the Website or communities is stored and processed by third-party service providers in accordance with their privacy policies and retention periods.
4.8 User Rights – In accordance with the Protection of Privacy Law, the user is entitled to review information stored about them, request correction, update or deletion of information, object to processing information for marketing purposes, and file a complaint with the Privacy Protection Authority in Israel.
4.9 Inquiries – Any request or question regarding privacy can be submitted via private message on any of the networks where we operate.
4.10 Information Security – We operate in accordance with the Privacy Protection Regulations (Information Security), and implement reasonable protection measures to prevent unauthorized use, leakage or exposure of personal information.
4.11 Information on Minors – Use of the Website and communities is intended for users over the age of 18 only. We do not intend to knowingly collect or store personal information about minors under the age of 18.
5. Direct Marketing
5.1 Advertising messages (as defined in the Communications Law – "Spam Law") will be sent only after receiving explicit consent (opt-in) from the user, and will include clear identification of the sender and immediate and convenient removal option.
5.2 Joining a community does not in itself constitute consent to receive direct advertising messages outside the regular activity of the community.
5.3 Sending BroadCast messages, email newsletters, direct Whatsapp, Telegram messages, or any other advertising message – will be done only after receiving separate and explicit consent from the user.
5.4 The user may at any time withdraw their consent, through the removal mechanism that will be attached to each advertising message or by contacting Website Operators.
6. Copyright and Trademarks
6.1 It is strictly prohibited to copy, reproduce, distribute, publish, translate, broadcast, store, publicly display or make any other use – commercial or private – of Website and community content, unless explicit prior written approval is obtained from Operators.
6.2 User Content: All content that users publish in communities remains their property, however the user grants Operators a non-exclusive, free, worldwide and unlimited time license to use this content for purposes related to the community and Website.
6.3 Responsibility for User Content: Operators are not responsible for any content uploaded by users in communities. Full and exclusive responsibility for this content lies with the users who uploaded it.
6.4 Trademark Disclaimer: The Website and communities of PokeMania are not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, or Amazon. All trademarks, names and logos mentioned on the Website and communities belong solely to their legal owners.
7. Limitation of Liability and Indemnification
7.1 As-Is Service – The Website, communities and all related services are provided as-is, without any warranty, commitment or representation from Operators.
7.2 Free Service – Use of the PokeMania Website and communities is provided to users free of charge. Website Operators do not charge users directly for use of the Website or communities.
7.3 No Commitment to Availability or Accuracy – Operators do not guarantee that the service will operate without interruptions, malfunctions or errors.
7.4 Limitation of Liability for Damages – Operators are not responsible for any damage, direct or indirect, consequential or special, that may be caused due to use of the Website, communities or external links.
7.5 Clarification Regarding Personal Information – Website Operators do not maintain an independent database and do not store users' personal information in internal systems. All information collection or personal information storage is done through third-party service providers.
7.6 Overall Limitation of Liability – Since the service is currently provided free of charge, it is agreed that in any case the overall liability of Operators towards users, if any liability is recognized by law, shall not exceed the amount actually paid to Operators (if paid).
7.7 Indemnification – The user undertakes to indemnify and compensate Operators, their employees, agents or those acting on their behalf for any damage, expense, claim or demand caused due to violation of these terms of use.
8. Jurisdiction
8.1 The applicable law is the laws of the State of Israel. Exclusive jurisdiction - the courts in the Tel Aviv-Jaffa District.
9. Miscellaneous
9.1 Severability: If any provision of these terms is determined to be invalid or unenforceable, this will not affect the other provisions, which will continue to be in full force.
9.2 Waiver: Non-exercise of a right by Operators, on a one-time or ongoing basis, will not constitute a waiver of this right or any other right.
9.3 Terms Update: Operators reserve the right to update or change these terms at any time. Updates will take effect upon publication on the Website.
9.4 Force Majeure: Operators will not be responsible for any delay, disruption or prevention in fulfilling their commitments resulting from events beyond their reasonable control.
